Several people were questioned, however no one was located that saw anything. While in the restaurant, Dfc. Brockman saw a male who had some injuries on his face. The male, Brandon Alexander Wenn admitted to being in a fight with David Scott Milligan but wanted nothing done about it. As Mr. Wenn was being escorted outside, Brockman located another male lying on the floor with a swollen and lacerated eye that was identified as David Scott Milligan. Both subjects accused the other for starting the fight and also refused medical attention. Mr. Milligan reported that he and Mr. Wenn have fought on prior occasions. Several witnesses did come forth, however they had difference of opinions how and who started the fight. Both subjects were advised of the process to request charges from the District Court Commissioner if desired.
On March 6th, the District Court issued a Criminal Summons for Brandon Alexander Wenn (24) of Barclay for Assault 2nd Degree. Mr. Wenn was served the summons on March 10th by Dfc. Larry Steenken.
