By all means, and it should be the law, if the case you bring to court is tossed, you need to pay the costs & more to the other party. this would unclog our court system immediately!

It certainly would cut out a lot of the frivolous lawsuits.

And discourage lower income families from initiating legal action against big business.
The only way this would work is if the law firm for the plaintiffs accepted financial responsibility for a loss.

Reminds me of an annoying little known fact about the whole business of junk lawsuits.. My Son was hit head on by a couple drunks many years ago.. at the crest of a hill, the drunks were completely on the wrong side of the road.. My Son was in his lane and the cars hit right front headlight area to right front.. that's how far over on the wrong side of the road they were. The drunks were injured and transported to the hospital so a field sobriety test was not performed but the police officer did note in his report that alcohol was involved. My wife and Son were co-owners of the car. Many months later they get notified of a lawsuit for injuries etc.. from the drunks. My wife was furious! We called my Insurance Agent and asked what is this all about?? The Agent explained it was common. The lawyers will file virtually any complaint knowing that most of the insurance companies will offer a settlement rather than suffer the expense of preparing a court defense. At that time my Agent further explained that a minimal defense costs the company at least $10-15K. So the easy thing to do is offer something less. The lawyers take 30% or more for writing the letter and the complainants get the rest. Easy money for the low life filing the suit and the lawyers writing the letters. By the way, my Agent told me at the same time it was worth the extra few dollars to get maximum coverage on your insurance. He said that in an at fault accident the skill of the lawyers assigned to defend you and commensurate with potential loss to the company. In other words, if you have minimum coverage you get the trainees. If you have maximum coverage you get the best lawyers the company has.. Imagine that..

When I was in the military, I was driving 2 other people in my truck to spend thanksgiving at a relatives of one's house.
En route, a car pulls out from a gas station, and hits my front fender.I remember sliding on the wet road and blacking out. Apparently he put me in the ditch, my truck rolled several times and ended up on its roof. His car was drivable, and he took off. Witnesses didnt get a plate or a good enough description.
To make a long story short, my two passengers had severe injuries. I was lucky, in that I was young and stupid, unbelted, and thrown clear from the carnage in the first roll. I wear it religiously now. You don't get that lucky twice.
My passengers, unbeknownst to me, sued my insurance company because they had no one else sue. My insurance at the time was State Farm. They never told me this was going on, but settled out of court for $50k each, and later dropped me as a customer because I had "reached their threshold for payout" because that $100k went on my account.
